Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by hazard:   On or about June 19, 2013, an employee was exposed to the hazards of being struck-by a power industrial truck while the employee operated the Caterpillar Forklift, model T40D, without using the seatbelt while moving material around the job site.

29 CFR 1910.215(b)(9):  The distance between the abrasive wheel periphery(s) and the adjustable tongue or the end of the safety guard peripheral member at the top exceeded one fourth inch:                                                                                                                           On or about June 19, 2013, and at times prior there to, an employee was exposed to the hazards of being struck by grinder wheel shrapnel, while standing in front of and using a Dayton grinder, Model 6K347, the peripheral tongue was not adjusted to within 1/4 inch of the wheel.
