OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing for likely to cause death or serious physical harm to employees in that The Respondent, a temporary staffing company did not coordinate sufficiently with it's client to ensure that temporary workers performing refuse collection during elevated heat conditions were trained in the health effects associated with, recognition of symptoms, and method of preventing heat illness:       On or about June 5, 2013, a temporary worker employed by Respondent who was collecting garbage suffered heat stroke while working for Respondent's client.    Among other methods, one feasible and acceptable abatement method to correct this hazard is to establish a heat stress management program which incorporates guidelines from the ACGIH's threshold limit values and biological exposure indices and/or the National Institute for Occupational Safety and Health (NIOSH) document, "Working in Hot Environments," and OSHA's Safety and Health Topics Page on Occupational Heat Exposure.  Such a program may include, but is not limited to:      1) Acclimatizing employees beginning work in hot environments or those returning from absent periods of three of more days.     2) Providing a training program for all employees, including temporary employees, contractors and part-time employees, regarding the health effects associated with heat stress, recognizing symptoms of heat-induced illnesses, and methods of preventing such illnesses.     3) Using dermal patches for monitoring core temperature to better identify when workers need to be removed from the work area.      4) Providing cool water and encouraging employees to drink 5 to 7 ounces of water every 10 to 15 minutes, rather than relying on thirst.     5) Coordinating with the host employer to implement specific procedures and lines of communication to be followed in the event of emergency situations or for employees displaying symptoms of injury or illness.
