OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to electrical hazards due to inadequate vegetation management: New Limerick Jobsite - Vegetation encroaching on sections of the approximately 1240' right-of-way between the main line and final pole to the residence had not been managed since 2000.

29 CFR 1910.269(a)(2)(vii): The employer shall certify that each employee has received the training required by paragraph (a)(2) of this section. This certification shall be made when the employee demonstrates proficiency in the work practices involved and shall be maintained for the duration of the employee's employment. 29 CFR 1910.269(c): "Job briefing." The employer shall ensure that the employee in charge conducts a job briefing with the employees involved before they start each job. The briefing shall cover at least the following subjects: hazards associated with the job, work procedures involved, special precautions, energy source controls, and personal protective equipment requirements. New Limerick Jobsite - The job briefing involving the hazards associated with the job, work procedures involved, special precautions, energy source controls, and personal protective equipment requirements was inadequate. On or about 06/21/2013, a Second Class "A" Lineman who responded to a residential power outage at approximately 9:00 PM, was electrocuted when his left shoulder contacted a hanging energized 14,400 volt primary wire in an overgrown wooded area.

29 CFR 1910.269(m)(2)(ii): If no system operator is in charge of the lines or equipment and their means of disconnection, one employee in the crew shall be designated as being in charge of the clearance. All of the requirements of paragraph (m)(3) of this section apply, in the order given, except as provided in paragraph (m)(2)(iii) of this section. The employee in charge of the clearance shall take the place of the system operator, as necessary. New Limerick Jobsite - During the response to a trouble call to the New Limerick jobsite, the employer did not designate an employee as being in charge of the clearance of an energized 14,400 volt primary line.
