OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:    (a)Road Bear RV Rentals & Sales@ 7685 Dahlia Street, Commerce City, CO 80022: On and before June 25th, 2013, the employer did not ensure portable fiberglass ladders used by employees did not have structural defects. Throughout the facility, fiberglass ladders were in use and had structural defects in the form of cracked and glued side rails. This condition exposed employees using the ladder to falling as a result of a structural failure.       Abatement Note: Among other methods, ANSI A14.5-2000, Portable Reinforced Plastic Ladder Safety Requirements, Section 14.5 provides, one feasible method of abatement is to: 1) Perform inspections and maintenance of ladders, and remove ladders from service when damaged as described in ANSI A14.5.

29 CFR 1910.132(a): Protective equipment, including personal protective equipment for extremities was not provided, used, and maintained wherever it is necessary by reason of hazards of processes encountered in a manner capable of causing injury or impairment in the function of any part of the body through physical contact:    (a) Road Bear RV Rental & Sales, 7685 Dahlia Street, Commerce City, CO 80022: On and before June 25, 2013, the employer did not provide employees with fall protection while working on the top of the RV roofs. These roofs exceed 12-13 feet high. This condition exposed employees to fall hazards.    (b) Road Bear RV Rental & Sales, 7685 Dahlia Street, Commerce City, CO 80022: On and before June 25, 2013, the employer did not provide employees with eye protection while utilizing the Ryobi table saw. This condition exposed employees to projectile hazards while conducting cutting operations using the table saw.

Employees were exposed to, flying projectiles, and fall hazards during maintenance operations.  The employer had not certified that a personal protective equipment hazard assessment had been performed.

29 CFR 1910.213(d)(1): Circular handfed cross-cut table saw(s) were not guarded by an automatically adjusting hood which completely enclosed that portion of the saw above the table and above the material being cut:     (a) Road Bear RV Rental & Sales @ 7685 Dahlia Street, Commerce City, CO 80022: On and before June 25th, 2013 the employer did not ensure  the point of operation on the Ryobi 10" table saw in the shop, was guarded at the exposed portion of the blade, to prevent employees from having any part of their body in the danger zone during operating cycles. This condition exposed the employee to the hazard of amputation.       Abatement Note:  This particular saw is used to cut wood.  To properly guard the saw:       (a)Each circular hand-fed ripsaw shall be guarded by a hood.       (1)The hood shall completely enclose that portion of the saw above the table and that portion of the saw above the material being cut.       (2)The hood and mounting shall be arranged so that the hood will automatically adjust itself to the thickness of and remain in contact with the material being cut but it shall not offer any considerable resistance to insertion of material to saw or to passage of the material being sawed.       (3)The hood shall be made of adequate strength to resist blows and strains incidental to reasonable operation, adjusting, and handling, and shall be so designed as to protect the operator from flying splinters and broken saw teeth. It shall be made of material that is soft enough so that it will be unlikely to cause tooth breakage.       (4)The hood shall be so mounted as to insure that its operation will be positive, reliable, and in true alignment with the saw; and the mounting shall be adequate in strength to resist any reasonable side thrust or other force tending to throw it out of line.       (b)Each hand-fed circular ripsaw shall be furnished with a spreader to prevent material from squeezing the saw or being thrown back on the operator.       (1)The spreader shall be made of hard tempered steel, or its equivalent, and shall be thinner than the saw kerf.       (2)The spreader shall be of sufficient width to provide adequate stiffness or rigidity to resist any reasonable side thrust or blow tending to bend or throw it out of position.       (3)The spreader shall be attached so that it will remain in true alignment with the saw even when either the saw or table is tilted.(c)Each hand-fed circular ripsaw shall be provided with nonkickback fingers or dogs so located as to oppose the thrust or tendency of the saw to pick up the material or to throw it back toward the operator. They shall be   designed to provide adequate holding power for all the thicknesses of materials being cut.

One of the prongs overheated and was burnt and melted. This condition exposed employees to electrical and electrocution hazards.

29 CFR 1910.303(g)(2)(i): Live parts of electric equipment operating at 50 volts or more were not guarded against accidental  contact by approved cabinets or other forms of approved enclosures, or other means listed under this provision:       (a) Road Bear RV Rentals & Sales @ 7685 Dahlia Street, Commerce City, CO 80022: On and before June 25th, 2013, the employer did not ensure that live parts operating at 50 volts or more were guarded against accidental contact to live electrical circuitry by an approved cabinet or other enclosure, in that, an opening measuring approximately 2"x 2" was open on the dead front of the electrical panel. The sub panel was located within the main office. The condition exposed employees to shock and electrocution hazards.

29 CFR 1910.304(g)(5): Grounding path. The path to ground from circuits, equipment, and enclosures was not permanent, continuous, and effective.    (a) Road Bear RV Rental & Sales, 7685 Dahlia Street, Commerce City, CO 80022: On and before June 25, 2013, the employer did not ensure a continious path to ground was effective, in that, the ground from a quad (4-shared) electrical outlet where a prong had snapped off an electrical plug and became permanently fixed inside one of the shared openings. The outlet was powering two cords plugged into 2 microwaves. This condition exposed employees to electrical and electrocution hazards.

29 CFR 1910.1200(e)(1): Employers did not develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met:    (a) Road Bear RV Rental & Sales @ 7685 Dahlia Street, Commerce City, CO 80022: On and before June 25, 2013 the employer did not develop, implement, and maintain at the workplace a site specific written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met.  The employer utilizes products such as biodegreaser, washing detergent, tire/vinyl dressing, and paint thinner. This condition exposed employees to chemical hazards.    Abatement Note:  The written hazard communication program will also include:   (1) A list of the hazardous chemicals known to be present using an identity that is referenced on the appropriate material safety data sheet (the list may be compiled for the workplace as a whole or for individual work areas); and,   (2) The methods the employer will use to inform employees of the hazards of non-routine tasks.
