29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: a) Worksite, 402 Cedar Lane, Sands Point, NY- Employees were working near a backhoe while installing two precast concrete drainage rings and one overflow pool at a private residence. The employees were not instructed to insure that the Operator, Signalman and other employees adjacent to the backhoe understand the signals to be used; on or about 6/26/13. Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

Note: In addition to abatement certification the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.
