29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. Crossbraces were used as a means of access. On or about June 25, 2013, during construction activities including, the installation of masonry brick and block, the employer did not ensure employees working on a fabricated frame scaffold had a safe means to access the scaffold side bracket work level located approximately 5 ft, 6 inches above the next scaffold level.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet above a lower level were not protected from falling to that lower level. On or about June 25, 2013, during construction activities including, the installation of masonry brick and block, the employer did not ensure employees working on a fabricated frame scaffold, approximately 13 feet, 6 inches high (3 scaffold sections), were protected by guardrails or other fall protection devices on the opens sides of the scaffold. VIP RESTORATION, INC. WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD, 29 CFR 1926.451(g)(4)(i), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 314605494, CITATION NUMBER 01, ITEM NUMBER 001, AND WAS AFFIRMED AS A FINAL ORDER ON July 13, 2010 WITH RESPECT TO A WORK PLACE LOCATED AT 3540 CROTON AVENUE, CLEVELAND, OHIO 44115.
