29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.  a) Jobsite:  Umbria Village - An employee was performing masonry operations from a fabricated frame scaffold, approximately 33 feet above ground level with no fall protection.  Observed on or about 6/27/13.    b) Jobsite:  Umbria Village - An employee was performing masonry operations from a fabricated frame scaffold, approximately 26 feet above ground level with no fall protection.  Observed on or about 6/27/13.    Note:  Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1926.451(g)(4)(i): Guardrail systems were not installed along all open sides and ends of platforms.   a) Jobsite:  Umbria Village - An employee was performing masonry operations within approximately 2 feet of the open end of an outrigger with no guardrail system approximately 31 feet above ground level, exposing the employee to a fall hazard.  Observed on or about 6/27/13.     b) Jobsite:  Umbria Village - An employee was performing masonry operations from a fabricated frame scaffold, within 2 feet of the open end with no guardrail system approximately 26 feet above ground level, exposing the employee to a fall hazard.  Observed on or about 6/27/13.     Note:  Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. 29 CFR 1926.451(f)(14): Makeshift devices, such as but not limited to boxes and barrels, were used on top of scaffold platforms to increase the working level height of employees:  a) Jobsite:  Umbria Village - An employee working from a fabricated frame scaffold approximately 26 feet above ground level with no fall protection climbed on top of three stacked cinderblocks, with bricks which he stacked on planks on the level above, exposing the employee to a fall hazard.  Observed on or about 6/27/13.    Note:  Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. 29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used:  a) Jobsite:  Umbria Village - A ladder or other means of access was not provided for employees performing masonry operations on the 5th level of a fabricated frame scaffold approximately 26 feet above ground level, exposing employees to a fall hazard.  Observed on or about 6/27/13.     b) Jobsite:  Umbria Village - A ladder or other means of access was not provided for employees performing masonry operations on an outrigger, approximately 5 feet above the working platform on the 5th level of a fabricated frame scaffold, exposing employees to a fall hazard.
