29 CFR 1910.243(c)(1): Abrasive wheel(s) were used on portable grinder(s) which were not provided with safety guard(s) meeting the requirements specified in 29 CFR 1910.243(c)(1) through (c)(4)(a): On or about June 27, 2013 and times prior thereto, employees were operating the portable 7 inch Makita grinder, grinding welds without a safety guard in place to protect them from being struck by fragmented wheel parts in the event of a broken disc.

29 CFR 1910.252(a)(2)(xiv)(C)(2): The employer did not ensure that if the work could not be moved, the supervisor had the combustibles moved to a safe distance from the work or had the combustibles properly shielded against ignition: On or about June 27, 2013 and times prior thereto, employer had a welding and cutting operation set up within twelve feet of a storage rack containing flammable liquids. Sparks or slag from the operation posed an ignition hazard to the flammables stored on the racks.

29 CFR 1910.253(b)(2)(ii): Inside of buildings, cylinders were not stored in a well-protected, well-ventilated, dry location, at least 20 feet (6.1 m) from highly combustible materials such as oil or excelsior: On or about June 27, 2013 and times prior thereto, employer had stored oxygen and acetylene tanks together and unsecured. Next to the main door way at the end of the building a collection of unsegregated full oxygen and fuel gas cylinders were stored upright and unsecured making them susceptible to being knocked over and creating struck-by and fire hazards.

On or about June 27, 2013 and times prior thereto, employer failed to keep floors and work area in a clean, orderly and sanitary condition. The front area of the building and washroom had signs of feline excrement and shop materials were not stored in an orderly fashion around the paint storage rack.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: On or about June 27, 2013 and times prior thereto, employer did not have in place a written hazard communication program that identified hazardous chemicals used in the work place, labeling methods, training of employee on the hazards associate with their use and material safety data sheets. Materials such as but not limited to John Deere Green Spray Paint, Sherwin Williams Red Oxide Shop Coat Primer and ACME Finish 1 Economy Thinner. These materials are labeled as flammable liquids and present fire and exposure hazards to employees if handled improperly.
