29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average (TWA)sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a) At the establishment located on 16710 Gator Road, Ft. Myers, FL employees performing activities such as; cutting, grinding and buffing granite material were exposed to high levels of noise. An employee was exposed during the 447 minute monitoring period to 102.7 percent of the allowable daily exposure, on or about, 07/16/2013. This dose is equivalent to 90.7 dbA as an 8-hour TWA. No hearing conservation had been established, on or about, 06/26/2013.

29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: a. At the facility located on 16710 Gator Road, Ft. Myers, FL, for employees required to use a half face, Sundstrom, respirator with dual organic vapor and pre-filter cartridges, as observed on or about, 06/26/2013. The respirator was used while spraying an adhesive product containing chemicals such as, but not limited to, methylene chloride. The employer had not established and implemented a written respirator program to include elements such as, but not limited to: medical evaluations, fit-testing and training of employees.
