29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: (a) Excavation site: On or about June 27, 2013, and at times prior, employees were exposed to cave in hazards from lack of adequate access and egress from the trench as the fixed ladder on the trench box was approximately five feet above the bottom of the trench.

29 CFR 1926.651(k)(2): Where the competent person finds evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees shall be removed from the hazardous area until the necessary precautions have been taken to ensure their safety: (a) Excavation Site: On or about June 27, 2013, and at times prior, employees were exposed to cave-in hazards while entering or exiting a trench that had a trench shield located so the bottom of the trench shield box was approximately 5 feet above the bottom of the trench. This created the hazard of the bottom of the excavation caving in and also put the lowest rung of the fixed ladder at such a height to impede safe egress.
