29 CFR 1910.95(c)(1): A continuing, effective hearing conservation program as described in paragraphs (c) through (n) of this section, was not instituted when employee noise exposures equaled or exceeded an 8-hour time-weighted average sound level (TWA) of 85 decibels: (a) On or about 07/11/2013, in the center bay, machine operator was not part of a hearing conservation program, working on the threading machine and cutting machine exposed to continuous noise at 100.6% of the permissible daily exposure limit (8 hour time weighted average sound level) or an equivalent sound level of approximately 90.0 decibels for 399 minutes. Zero exposure was assumed for 81 minutes. (b) On or about 07/11/2013, in the center bay, machine operator was not part of a hearing conservation program, working on the threading machine exposed to continuous noise at 94.7% of the permissible daily exposure limit (8 hour time weighted average sound level) or an equivalent sound level of approximately 89.6 decibels for 432 minutes. Zero exposure was assumed for 48 minutes.

29 CFR 1910.95(i)(3): Employees were not given the opportunity to select their hearing protectors from a variety of suitable hearing protectors provided by the employer: (a) On or about 07/11/2013, in the center bay, machine operator was not part of a hearing conservation program, working on the threading machine and cutting machine exposed to continuous noise at 100.6% of the permissible daily exposure limit (8 hour time weighted average sound level) or an equivalent sound level of approximately 90.0 decibels for 399 minutes. Zero exposure was assumed for 81 minutes. Employee was provided only with Howard Leight ear plugs. (b) On or about 07/11/2013, in the center bay, machine operator was not part of a hearing conservation program, working on the threading machine exposed to continuous noise at 94.7% of the permissible daily exposure limit (8 hour time weighted average sound level) or an equivalent sound level of approximately 89.6 decibels for 432 minutes.
