29 CFR 1910.1048(d)(1)(i): Each employer who has a workplace covered by this standard shall monitor employees to determine their exposure to formaldehyde.  a) Facility wide- The employer did not perform air monitoring for those employees exposed to formaldehyde. True Keratin which was found to contain 3.13% formaldehyde. The condition was noted on or about 06/25/13.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER 29 CFR 1903.19.

29 CFR 1910.1048(m)(5): Written hazard communication program. The employer shall develop, implement, and maintain at the workplace, a written hazard communication program for formaldehyde exposures in the workplace, which at a minimum describes how the requirements specified in this paragraph for labels and other forms of warning and material safety data sheets, and paragraph (n) for employee information and training, will be met. Employers in multi-employer workplaces shall comply with the requirements of 29 CFR 1910.1200(e)(2).  a) Facility wide- Employees performing the keratin hair treatment are exposed to formaldehyde which is contained in True Keratin. Bulk samples taken on 08/16/13 were found to contain 3.13% formaldehyde. The formaldehyde is released during the blow drying and flat iron application. The employer shall assure that all employees who are assigned to workplaces where there is exposure to formaldehyde participate in a training program, except that where the employer can show, using objective data, that employees are not exposed to formaldehyde at or above 0.1 ppm, the employer is not required to provide training.  a) facility wide- The employer did not train those employees exposed or potentially exposed to formaldehyde while using True Keratin which was found to contain 3.13% formaldehyde. The formaldehyde is released during the blow drying and flat iron application, on or about 06/25/13. 29 CFR 1910.1200(a)(1): The purpose of this section is to ensure that the hazards of all chemicals produced or imported are evaluated, and that information concerning their hazards is transmitted to employers and employees. This transmittal of information is to be accomplished by means of comprehensive hazard communication programs, which are to include container labeling and other forms of warning, material safety data sheets and employee training.  a) Facility wide- The employer did not establish and implement a written hazard communication program where employees exposed to hazardous chemicals while performing work tasks (e.g. formaldehyde in True Keratin). Employees were exposed to formaldehyde at 3.13%. The condition was noted on or about 06/25/13. 29 CFR 1910.1200(b)(4)(iii): Employers shall ensure that employees are provided with information and training in accordance with paragraph (h) of this section (except for the location and availability of the written hazard communication program under paragraph (h)(2)(iii) of this section), to the extent necessary to protect them in the event of a spill or leak of a hazardous chemical from a sealed container.   a) facility wide- Employees are exposed to chemicals during work tasts (e.g. formaldehyde) and exposed to but not limited to bleach, hair dyes, and smoothing hair treatments. The employer did not ensure that employees were trained and provided with information as required by this paragraph. The condition was noted on or about 06/25/13.   NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER 29 CFR 1903.19.
