29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c):  a) West Side of the Building - A laborer was entering unprotected 10 feet deep excavation to check water discharge from an existing manhole by stepping down onto a ladder in the excavation exposing him to a potential cave-in  hazard, on or about 06/27/13. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.1053(b)(13): The top or top step of a stepladder was used as a step:   a) West Side of the Building in the Alley - A laborer was stepping onto the top rung of an 8 foot step ladder which was leaning against the side of the unprotected excavation, in order to check the water flow from a manhole, exposing him to a potential fall hazard, on or about 06/27/13.   Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
