29 CFR 1926.20(b)(2): The employer did not initiate and maintain a program of frequent and regular inspections made by competent persons at the jobsite: a) Inspections of the upper catwalk (roof) were not provided; There were several uncovered gaps in the floor of the catwalk where wood planks were missing or had been removed from around the columns. Employees were exposed to falling 34 ft. Location: WTC Freedom Tower, New York, N.Y. On or about 6/26/2013 NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.754(e)(4): Decking gaps around columns. Wire mesh, exterior plywood, or equivalent, shall be installed around columns where planks or metal decking do not fit tightly. The materials used must be of sufficient strength to provide fall protection for personnel and prevent objects from falling through. a) Mesh or equivalent was not provided at the gap openings where the columns go through the catwalk. During steel construction activities employees were exposed to fall hazard at the openings, and tools and materials can fall onto employees walking/ working below. Location: WTC Freedom Tower, New York, N.Y. On or about 6/26/2013 NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.761(b): Fall hazard training. The employer did not ensure that employees who are exposed to fall hazards during steel erecting activities were effectively trained in fall protection procedures and hazard recognition, and ensure employee participation in the program: a) Employees were exposed to falling 34 feet at gaps near the columns on the catwalk; employer did not ensure that employees use fall protection means and methods available including (a) covering the gaps with wood planks, and (b) use retractable lifelines so the employee will not have to disconnect their personal fall arrest system when moving. Location: WTC Freedom Tower, New York, N.Y. On or about 6/26/2013 NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19.
