OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards from falling stock.  a)  Warehouse:  On or about May 2, 2013 and at times prior thereto, the employer failed to ensure that damaged storage racks whose structural integrity had become compromised were repaired or that section(s) of racks taken out of service until they could be repaired which exposed employees to the hazards associated with getting struck-by falling product and sections of rack.  b)  Storage racks throughout the warehouse:  On or about May 2, 2013 and at times prior thereto, the employer exposed his employees to struck-by hazards by falling product and sections of rack in that the employer failed to ensure that column base plates of storage racks were anchored to the floor with anchor bolts.  c)  Storage racks throughout the warehouse:  On or about May 2, 2013 and at times prior thereto, the employer exposed his employees to struck-by hazards by falling product and sections of rack in that the employer failed to ensure that a placard indicating the rack's maximum loading capacity was conspicuously displayed on the storage racks.

29 CFR 1910.147(c)(4)(i): Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section:  a)  Hydraulic shear in the Rebar Shop;  On or about May 2, 2013 and at times prior thereto, the employer exposed his employees to potential hazardous energies hazards in that employees were allowed to work on the hydraulic shear which had multiple energy sources consisting of electrical, air, and hydraulic without those employees having a machine specific lock-out procedure to ensure those energy sources were controlled while the employees were performing maintenance or servicing on the machine.

29 CFR 1910.147(c)(7)(i): The employer did not provide training to ensure that the purpose and function of the energy control program are understood by employees and that the knowledge and skills required for the safe application, usage, and removal of the energy controls are acquired by employees:  a)  Hydraulic shear and other machinery throughout the Rebar Shop;  On or about May 2, 2013 and at times prior thereto, the employer exposed his employees to potential hazardous energies hazards in that authorized, affected, and other employees had not been provided with the level of training required that ensures that the purpose and function of the energy control program and the knowledge and skills required for the safe application, usage, and removal of the energy control device(s) was acquired by the employees.

29 CFR 1910.179(k)(2): Rated load test reports were not placed on file where they were readily available to appointed personnel:   a)  Rebar Shop;  On or about May 2, 2013 and at times prior thereto, the employer did maintain test reports showing a rated load test had been performed (on a 6 ton girder bridge crane) when it was new or altered prior to it's initial use.
