29 CFR 1910.132(a):  Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered:    (a)   A Touch of Class Tree Service Inc. at 1200 Willow St, Denver, CO 80220:  On June 21, 2013 the employer did not ensure that each employee was provided with appropriate personal protective equipment (PPE), in that one employee operating a chainsaw on the ground was not wearing cut-resistant leg protection.  This condition exposed the employee to the hazards of cuts and amputations.    OR IN THE ALTERNATIVE   Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer furnish a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the following serious hazards:     (a)   A Touch of Class Tree Service Inc. at 1200 Willow St, Denver, CO 80220:  On June 21, 2013 the employer did not ensure that each employee was provided with appropriate personal protective equipment (PPE), in that one employee operating a chainsaw on the ground was not wearing cut-resistant leg protection.  This condition exposed the employee to the hazards of cuts and amputations.    Abatement Note:  Among other methods, American National Standards Institute (ANSI) Z133.1-2000 Section 4.2 provides that one feasible and acceptable abatement method includes providing personal protective equipment and requiring its use.

29 CFR 1910.333(c)(3):  Work was performed near overhead lines without ensuring the lines were de-energized and grounded, or ensuring other protective measures were provided before work was started:  (a)  A Touch of Class Tree Service Inc. at 1200 Willow St, Denver, CO 80220:  On June 21, 2013 the employer did not ensure an overhead street light power line was de-energized and grounded before working near the energized line during tree removal operations.  The street light power line was energized at 110 volts.  An employee worked from inside the bucket of an articulating boom truck by positioning the boom up and over the street light power line.  This condition exposed the employee to the hazards of electrical shock.
