29 CFR 1926.453(b)(2)(v): Each employee working from an aerial lift was not protected from falling by wearing a harness with a lanyard attached to the boom or basket: On or about Jul 02, 2013, an employee on the East side of the building was exposed to a fall of approximately 20 feet in height to the unpaved ground level below, while using an aerial lift to reach the side of the building, to install metal framing studs.

29 CFR 1926.454(a): The employer did not have each employee that was performing work on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable: On or about July 2, 2013, an employee operating an aerial lift on the East side of the building had not received proper training on how to operate, and recognize potential hazards associated with the operation of aerial lifts, the employee was working from the aerial lift installing metal frame studs, approximately 20 feet in the air.
