OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees  a) Warehouse- On or about July 02, 2013, the employer allowed an employee to operate a Caterpillar propane forklift that did not have a seatbelt while transporting and moving paint products, exposing the employee to ejection, struck-by and crushing hazards.   ABATEMENT CERTIFICATION IS REQUIRED.

29 CFR 1910.106(d)(5)(i): "Egress." flammable liquids, including stock for sale, were stored in a location that limited the use of exits, stairways, or areas normally used for the safe egress of people.  a) At the Warehouse, on or about and at times prior to July 02, 2013, the employer did not ensure that the exit door was free from all obstructions including stored flammable paint products, exposing employees to a fire hazard.    CORRECTED DURING THE INSPECTION.

29 CFR 1910.157(c)(1): Portable fire extinguishers were not mounted, located and identified so that they were readily accessible without subjecting the employees to injuries:   a) At the Paint Mixing Room, on or about and at times prior to July 02, 2013, a fire extinguisher was not mounted on the wall and was on the floor in the area designated by the employer to store paints, exposing employees to a fire hazard. The fire extinguisher was next to the metal shelves used to store the paint products and next to the rooms door.    b) At the Warehouse, on or about and at times prior to July 02, 2013, a fire extinguisher was not mounted and was on the wall beam next to the exit door, exposing employees to a fire hazard. The fire extinguisher was located in the area designated to store the paint products inside the warehouse and next to the exit door leading outdoors.   ABATEMENT CERTIFICATION IS REQUIRED.
