29 CFR 1910.1200(e)(1): Employer did not develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met, and which also includes the following:  This standard is applicable in construction under 29 CFR 1926.59  The employer did not develop, implement, and maintain at the workplace a written hazard hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) will be met.

29 CFR 1910.1200(g)(1): Chemical manufacturers and importers shall obtain or develop a material safety data sheet for each hazardous chemical they produce or import. Employers shall have a material safety data sheet in the workplace for each hazardous chemical which they use.  This standard is applicable in construction under 29 CFR 1926.59  Job site located at Levee #R-62, Peru, NE-The employer did not obtain or develop a material safety data sheet for each hazardous chemicals they produce or import.  The employer did not have a material safety data sheet for all of the products such as, but not limited too, diesel fuel, hydraulic fluid and motor oil for the equipment used at the site.

Job site located at Levee #R-62, Peru, NE-The employer had a set of portable stairs leading into the back of the construction trailer that was not equipped with a stairrail system along each unprotected side or edge.
