29 CFR 1926.95(a): Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact.     (a) 2464 Hempstead Turnpike, East Meadow, NY (Worksite), north and east fabricated frame scaffolds, north and east sides of building  Employees were removing imperfections from the Styrofoam insulation, by sanding the surface with rasps, in preparation for the stucco application. The operation created flying particles, Styrofoam  beads and shavings, that could come into contact with the eyes. The employees were performing this operation without eye protection on, or about July 5, 2013.      Note: The employer is required to submit abatement certification for this violation in accordance with 29 CFR 1903.19.

(a) Worksite, east fabricated frame scaffold, east side of building - The east scaffolds second and third level end frames had cross braces that were being held in place with 16-gauge tie wire, which was not capable of supporting 4 times the intended load. Employees working from platforms located on those levels and were exposed to falls ranging between 14'-6" and approximately 17' to the ground below on, or about July 5, 2013. The overall width of the work platform was increased using side brackets, but was not fully planked or decked between the 57" wide uprights. The employees were exposed to falls of 6'-8" and 13' to the ground below on, or about July 5, 2013.    (b) Worksite, east fabricated frame scaffold, east side of building - Two employees were working on the second level of the east fabricated frame scaffold. The overall width of the work platform was increased using side brackets, but was not fully planked or decked between the 57" wide uprights. The employees were exposed to a fall of 14'-6" to the ground below on, or about July 5, 2013. Crossbraces were used as a means of access.     (a) Worksite, north fabricated frame scaffold, north side of building - Employees moved between the first and second levels of the north scaffold by climbing on the end frames and were not provided with a safe means of access. The employees were exposed to fall hazards of up to 13' on, or about July 5, 2013.      (b) Worksite, east fabricated frame scaffold, east side of building - Employees moved between the first, second and third levels of the east scaffold by climbing on the end frames and were not provided with a safe means of access.  The employees were exposed to fall hazards of up to 17' on, or about July 5, 2013.
