OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to crushing injuries from inadequate guarding during the use of stand-up forklifts.  Feasible abatement methods include, but are not limited to the following:  1.  Lower all shelves in the warehouse so that the rear of the standup forklift cannot slide under them.  2.  Utilize trucks that have raised rear frames or corner posts that would not allow the truck to pass under the storage racks.  3.  Follow the guidelines outlined in ANSI/ITSDF B56.1-2012.        In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1910.178(l)(3): Training program content. Powered industrial truck operators shall receive initial training in the following topics, except in topics which the employer can demonstrate are not applicable to safe operation of the truck in the employer's workplace:    (a)  Employees operating the Toyota Stand-up Forklift, did not receive adequate initial training, in that the formal instruction they received did not cover the specific type of forklift they were going to operate and the written evaluation (test) did not cover the the specific type of forklift they were going to operate and some employees were allowed to take the written test while watching a video and sharing answers with other employees.        In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1910.212(a)(1): Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices,electronic safety devices, etc.:    (a)  Employees operating the Hydraulic Bearing Press (Machine ID 3025) were exposed to getting a hand caught between the hub and the table when the hub was lowered to the table.       In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.
