29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of job site, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them): (a) W.M. Brown Construction @ 7175 Federal Blvd., Westminster, CO: On and before July 8th, 2013, the controlling employer did not ensure frequent and or regular inspections were conducted by a "competent" person to determine the strength and structural integrity of the three story stick framed building was maintained throughout the construction process. On July 8th, 2013, two subcontractor framing employees conducting sheathing operations fell approximately 30 feet as a result of the collapse of the southeast cantilevered roof structure.

29 CFR 1926.501(a)(2): Employees were allowed to work on surfaces which did not have the requisite strength and structural integrity: (a) W.M. Brown Construction @ 7175 Federal Blvd., Westminster, CO: On and before July 8th, 2013, the controlling employer in charge of the worksite did not ensure the strength and structural integrity of the cantilevered roof section located on the southeast corner of the building was maintained throughout the construction process. On July 8th, 2013, two subcontractor framing employees sheathing the southwest corner of the roof were walking and working on the inadequately supported trusses and fell 30 feet after the cantilevered roof section collapsed. (b) W.M. Brown Construction @ 7175 Federal Blvd., Westminster, CO: On and before July 8th, 2013, the controlling employer in charge of the worksite did not ensure the strength and structural integrity of the cantilevered roof section located on the southwest corner of the building was maintained throughout the construction process.
