29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:    a) Worksite, South side - Employees were using an unsecured ladder to gain access to the roof. The ladder side rails were approximately 12 inches above the upper landing; on or about 07/09/13.    Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a)  NOTE TO CSHO: USE THIS OPTION ONLY IN CASES WHERE THE INFEASIBILITY/GREATER HAZARD EXCEPTION IS NOT IN ISSUE.    a) Worksite, Southeast side roof - An employee installing sheathing approximately 18 feet above the ground on an approximate 5-12 pitch roof had a harness and a lanyard on but was not attached to the lifeline. The employee was not protected from falling; on or about 07/09/13.    b) Worksite, Northeast side roof - An employee installing sheathing approximately 18 feet above the ground on an approximate 8-12 pitch roof had a harness and a lanyard on but was not attached to the lifeline. The employee was not protected from falling; on or about 07/09/13.    Note:   Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.      F.E.C. Construction Corp. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 691318, citation number 1, item number 2, and was affirmed as a final order on 1/29/13, with respect to a workplace located at 610 East Broadway, Long Beach NY.
