29 CFR 1926.652(a)(1): 29 CFR 1926.652(a)(1):      Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c):     a)  On July 3, 2013 the employee(s) entered an unprotected excavation that measured approximately 14' feet wide by 18' feet long and 7' feet and greater in depth with nearly vertical side walls. Employees entered the excavation to check sub-grade, set grade stakes, and to screed and level concrete pour to established a meter pit slab floor. The excavation was not adequately sloped to 1-1/2 to 1 as required for type C soil conditions. Employees were exposed to the potential collapse of the unprotected side walls.     b)  On July 8, 2013 the employer directed employees to enter the same unprotected excavation to signal D60 track hoe operator to clean silt, mud, and other earthen material off the previously poured meter pit concrete slab floor. Employees used hand shovel to clean the remainder of the excavated material off the meter pit concrete floor. Employees were exposed to the potential collapse of the unprotected side walls.
