OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to workers, in that employees worked outdoors in direct sunlight for a total of approximately 12 hours, with a heat index that reached a high of 97 degrees Fahrenheit, performing deck work. Naval Station Norfolk, Pier 5, USS Nitze, 3GT Exhaust Deck: On or about 07/05/13, employees working outdoors in direct sunlight, were preparing the deck for non-skid application. The employees worked in direct sunlight during the hours of 7:00a.m. - 11:30a.m., and 12:00p.m. - 7:00p.m. The heat index as reported by NOAA for Naval Air Station Norfolk reached a high of 97 degrees Fahrenheit. One employee performing cleanup operations collapsed at approximately 6:00p.m., was transported to the local hospital, and eventually died.
