29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered: (a) Warehouse. On or about July 10, 2013, employees utilizing Crown 30SP36TT cherry picker for retrieving boxes and parts from approximately 4-15 ft. high, were exposed to falls where adequate fall prevention system was not provided. There is no abatement certification or documentation required for this item.

29 CFR 1910.178(l)(1)(ii): The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a powered industrial truck: a) Warehouse. On or about July 10, 2013, employees operating forklifts were not fully trained and evaluated for safe operation. Abatement certification is required of this item in accordance with the requirements of 1903.19(c).
