29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:   1) 176 Divsion Street, 4th Floor: On or about 07/02/2013; the employer did not provide a medical evaluation to an employee required to wear a 3M Half mask tight fitting respirator to perform abrasive blasting work at the site.    NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1910.134(h)(2)(i): Respirators were not stored to protect them from damage, contamination, dust, sunlight, extreme temperatures, excessive moisture, and damaging chemicals or  were not packed or stored to prevent deformation of the facepiece and exhalation valve:   a) 176 Division Street; 4th Floor: On or about 07/12/2013; the employer did not ensure that respiratory protection equipment such as, but not limited to a 3m Half Mask respirator with P100 filters; used by an employee performing abrasive blasting at the site was properly stored to protect from damage, dust and contamination.    NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
