29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access: a) Rear Elevation of Deck - Employees were exposed to the hazard of falling approximately 15 feet where a portable extension ladder did not extend above the landing surface a roof deck. b) Side Elevation of Deck - Employees were exposed to the hazard of falling approximately 10 feet where a portable extension ladder did not extend above the landing surface a roof deck. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b): a) Side and Rear Elevations of Building - Employees were exposed to the hazard of falling while engaged in roofing work without the use of fall protection on a roof deck having a ground to eave height of about 20 feet and a pitch of approximately 10/12. b) Rear Elevation of Building - Employees were exposed to the hazard of falling approximately 15 feet while on a deck without fall protection. Art Roofs & Gutters, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501 (b)(13) which was contained in OSHA inspection number 312320377, citation 1, item 5b, and was affirmed as a final order on November 6, 208, with respect to a worksite located at 700 Loyd Place, Winnetka, Illinois. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.
