29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):    The employer failed to protect employees from potential fall hazards associated with roofing a new residential home with a roof height over 10 ground to eve.  The most recent example of this was found on the job site located at 6801 Tempest Road, Lincoln, NE 68501 where the employer had employees re-roofing an existing residential home with ground eve heights over 10 and roof pitch greater than 4-12 without adequate fall protection.  Instances of inadequate fall protection include but are not limited to:  i.    Wearing a fall arrest harness without having a shock absorbing lanyard.  ii.   Wearing a fall arrest harness without having a rope and rope grab assembly.  iii.   Wearing a fall arrest harness without having an anchor point secured to the top of the roof peak.  iv.   Lack of guard railing along the eves of the house.  v.    Lack of a safety net along the eves of the house.

29 CFR 1926.1053(b)(1):Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladders length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder(s) was/were not secured at its top to a rigid support, and/or a grasping device, such as a grab rail, was not provided to assist the employees in mounting and dismounting the ladder:                                                                                                           The employer failed to meet the requirements of this paragraph of the subpart in that they are failing to ensure that employees are using a ladder in accordance with the standards outlined in the regulation.  The most recent example of this was found on the job site located at 6801 Tempest Road, Lincoln, NE 68501 where the employer has employees roofing a new residential home with ground eave heights over 10 and roof pitch greater than 4-12; using an extension ladder as a means of access and the ladder does not extend the minimum 3 above the walking/working surface.
