29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  (a)  Location - Production Area An employee cutting vinyl fence parts, was exposed to noise levels at 112.7% of the allowable eight hour time-weighted-average sound level (90dBA).  The equivalent dBA level of the 112.7% is approximately 90.9 dBA which is capable of causing permanent hearing loss.  The sampling was performed for 417 minutes during one work shift on July 10, 2013.  Zero exposure was assumed for the unsampled period of 63 minutes.  (b)  Location - Production Area An employee cutting vinyl fence parts, was exposed to noise levels at 223.0% of the allowable eight hour time-weighted-average sound level (90dBA).  The equivalent dBA level of the 223.0% is approximately 95.8 dBA which is capable of causing permanent hearing loss.  The sampling was performed for 444 minutes during one work shift on July 10, 2013.  Zero exposure was assumed for the unsampled period of 36 minutes.
