29 CFR 1910.24(b): Fixed stairs were not provided where access to elevations was daily or at each shift for such purposes as gauging, inspection, regular maintenance, etc., where such work may expose employee(s) to acids, caustics, gases, or other harmful substances, or for which purposes the carrying of tools or equipment by hand is normally required: On or about July 11, 2013, the employer did not provide fixed stairs to access the rooftop where employees and subcontractors may be exposed to anhydrous ammonia during maintenance of the refrigeration system equipment.

29 CFR 1910.119(e)(5): The employer did not complete actions to resolve PHA recommendations as soon as possible. On or about July 11, 2013, the employer did not complete actions necessary to resolve the PHA recommendations from 2011, including but not limited to, the following: a) Recommendation #10 to install nipples near the tops of the low pressure receiver and suction accumulator level columns to assist with testing the high-high level float. b) Recommendation #47 to install a maintenance platform or ladder to allow safe access to the top of the condenser, and adding discharge piping to the pressure-relief valves on the condenser so they vent to a safe location. c) Recommendation #55 to label on the P&IDs all valves on piping between pump-discharge relief regulators and the vessels they discharge into "tag and seal open"
