OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:   On or about July 11th 2013, and at times prior, employees were exposed to crushing and struck-by injuries in that:   a) Auto lifts were not periodically inspected by qualified inspectors at least annually to ensure that they were properly maintained and functioning.   b) The employer had not trained employees on the safe use and operation of the lifts using the manufacturer's provided instructions.   c) At least eight out of twenty-nine lifts at this location did not have posted information related to the load capacity.   d) At least twenty of the lifts had discrepancies on the posted load capacities. The load capacity posted on the lift controls was different than the load capacity posted on the swing arms. There was used oil and other flammable materials in the immediate area.   b) On or about July 11th 2013, and at times prior, Larry H. Miller Toyota Scion of Colorado Springs did not ensure that their fire extinguishers were fully charged. A fire extinguisher mounted on the wall of the detailing bay was found to be discharged.
