29 CFR 1926.652(a)(1): 29 CFR 1926.652(a)(1) Each employee in an excavationwas not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c): a) On or about 7/11/13 at a water line project located near 6416 John Avenue, Niagara Falls, New York; employeee installing a new water line were working in a trench that was approximately 6'-6" deep with vertical walls. There was a shield in in the trench, but the employees were working outside of the protection of the shield. NO ABATEMENT CERTIFICATION REQUIRED
