29 CFR 1910.132(b): Employee-owned equipment: Where employees provide their own protective equipment, the employer did not assure its adequacy, including proper maintenance, and sanitation of such equipment:        On or about July 11, 2013, employees who washed vehicles were exposed to contact with cleaning chemicals.  Cleaning agents, such as, but not limited to caustic corrosive liquids, glass cleaners, and degreasers, were used in all phases of the wash process.  Employees were allowed to provide their own personal protective equipment such as gloves, safety glasses, and boots without any employer oversight.

29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE):  On or about July 11, 2013, employees who washed vehicles were exposed to contact with cleaning chemicals.  The cleaning agents, such as, but not limited to caustic corrosive liquids, were used in all phases of the wash process.  No system to assess hazards, select correct personal protective equipment, and require its use was developed.

29 CFR 1910.133(a)(1): Protective eye and face equipment was not required where there was a reasonable probability of injury that could be prevented by such equipment:    On or about July 11, 2013, employees who washed vehicles were exposed to contact with cleaning chemicals.  Cleaning agents, such as, but not limited to caustic corrosive liquids, glass cleaners, and degreasers, were used in all phases of the wash process.  Eye and facial protection was inadequate as follows.  A.  A consistent supply of protective eye equipment was not provided.  B.  No personal protective equipment to provide facial protection from chemical splashes was available.

Cleaning agents, such as, but not limited to, Brilliant Wheel and Tire NA (caustic corrosive liquid, eye and skin contact hazard), Auto Beauty Motor Degreaser (caustic corrosive and degreaser, eye and skin contact hazard), and glass cleaners (eye and skin irritant) were used in all phases of the wash process.

29 CFR 1910.147(c)(4)(i): Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section:      On or about July 11, 2013, employees who performed maintenance on the wash system were exposed to the hazard of contact with unintended energy should the system not be deenergized properly.  Written procedures were required for processes in the facility such as but not limited to, the Belanger automated conveying and washing system and for the pressurized spray system in the pre-wash area.  Employees could be caught in moving equipment or receive chemical burns if the equipment is not deenergized prior to maintenance activities.

29 CFR 1910.151(c): Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use:        On or about July 11, 2013, employees who washed vehicles were exposed to contact with corrosive cleaning chemicals.  Caustic and corrosive wheel and tire cleaner was used in the pre-wash area, however no suitable means of flushing the eyes and/or body was provided in that area.

29 CFR 1910.242(a): The employer did not ensure that employees were furnished with tools and equipment that were in a safe condition:        On or about July 11, 2013, employees who washed vehicles were exposed to contact with corrosive cleaning chemicals.    Brilliant Wheel and Tire NA, containing sodium metasilicate and sodium hydroxide, was diluted with water and then dispensed to an applicator valve with a rubber air hose.  The hose material had deteriorated and its integrity was compromised.
