The certification shall include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation. a) On or about 7/11/13, on medical office building construction site at 5959 Big Tree Rd., Orchard Park, NY: The employer did not certify that the operator of a Gehl Model 5240 Skid-Steer Loader had been trained and evaluated and found competent to operate the Loader safely. ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.601(b)(4): The employer had in use motor vehicle equipment having an obstructed view to the rear which did not have a reverse signal alarm audible above the surrounding noise level or an observer signaling it was safe to back up the vehicle. a) On or about 7/11/13, on medical office building construction site at 5959 Big Tree Rd., Orchard Park, NY: Employee used a Gehl Skid-Steer Loader, Model 5240, stenciled ID # 50605, to move plastic pipes with the forklift attachment. The loader was operated in both forward and reverse. The loader was equipped with a back-up alarm, but it was not working, and no observer was present to signal the operator that it was safe to back up. NO ABATEMENT CERTIFICATION REQUIRED
