The employee working the glass polishing machine is required to wear a respirator.  The employer did not have or implement a written respiratory protection program.

29 CFR 1910.134(d)(1)(ii): The employer did not select and use a NIOSH-certified respirator in compliance with the conditions of its certification:    On or about July 16, 2013:   The employee working the glass polishing machine was observed wearing a surgical mask without markings to indicate NIOSH approval.  The employee is required by the employer to wear a N95 particulate respirator.  The employer did not ensure the employee was properly protected with a NIOSH certified filtering face-piece.
