29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: On or about July 15, 2013, the employer did not implement and maintain a hearing conservation program for the employees exposed to noise levels ranging from 86.5 to 89.1 dBa TWA, exposing employees to loss of hearing hazards. An effective hearing conservation program includes, but may not be limited to, the following elements: a) Noise monitoring and exposure assessment for employees in distinct work areas. b) Training employees on the effects of high noise on hearing ability and damages to sensory tissues. c) Baseline and annual audiometric testing to record hearing ability among workers.

29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: On or about July 15, 2013 the employer did not develop, implement, or maintain a copy of the respiratory protection program for the employee(s) using half-mask, tight-fitting respirators while exposed to silica dust during the dry grinding method. Elements of a written respiratory protection program include, but may not be limited to, the following: a) Medical evaluations of employees required to use respirators. b) Fit testing procedures for tight-fitting respirators. c) Procedures for proper use, cleaning, storage and maintenance of respirators. d) Training of employees in the respiratory hazards, proper use and care of respirator, and the limitations of the respirator.
