29 CFR 1926.451(f)(7): Scaffolds were not erected, moved, dismantled, or altered, by trained and experienced employees under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration:; Such activities were not performed only by experienced and trained employees selected for such work by the competent person.    a)  At the jobsite, on or about 7/2/13:  An employee was working on a carpenters bracket scaffold at approximately 9 feet from ground, where those brackets were installed approximately 10 feet apart, and not in keeping with the manufacturers instructions.    Abatement certification must be submitted for this item.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.  a)  At the jobsite, on or about 7/2/13:  An employee was working on a carpenters bracket scaffold at approximately 9 feet from ground, where those brackets were installed approximately 10 feet apart, and not in keeping with the manufacturers instructions and without being trained on the hazards associated with working on this type of scaffold.  Abatement certification must be submitted for this item.

29 CFR 1926.502(d)(16)(iii): Personal fall arrest systems, when stopping a fall, were not rigged such that an employee could not free fall more than 6 feet (1.8 m) nor contact any lower level:    a)  At the jobsite, on or about 7/2/13:  An employee was working on a 6:12 pitch roof, with an approximate 14 foot ground to eave height and while wearing a harness with a lanyard and rope grab device, and where the rope had been played out to allow a 6 foot free falll and a likely contact with the building side in the event of a fall.    Abatement certification must be submitted for this item.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  a)  At the jobsite, on or about 7/2/13:  An employee was working on a 6:12 pitch roof, with an approximate 14 foot ground to eave height and while wearing a harness with a lanyard and rope grab device, and where the rope had been played out to allow a 6 foot free falll and a likely contact with the building side in the event of a fall.  Training had not been provided for employees to recognize hazards and protective measures when working at heights.    Abatement certification must be submitted for this item.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder rails length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:    a)  At the jobsite on the side of the building, on or about 7/2/13:  An employee accessed a plank on a carpenters bracket scaffold to then gain access to the roof, where the ladder did not extend at least 3 feet above the plank.    b)  At the jobsite, on the front of the building, on or about 7/2/13:  An employee accessed a pick on a carpenters bracket scaffold where that ladder did not extend at least 3 feet above the pick surface.

29 CFR 1926.1060(a): The employer did not provide a training program for each employee using ladders and stairways, as necessary, which would enable each employee to recognize hazards related to ladders and stairways and train each employee in the procedures to be followed to minimize these hazards:  a)  At the jobsite on the side of the building, on or about 7/2/13:  One employee accessed a plank on a carpenters bracket scaffold to then gain access to the roof, where the ladder did not extend at least 3 feet above the plank. Another employee accessed a pick on a carpenters bracket scaffold where that ladder did not extend at least 3 feet above the pick surface.  Neither employee had been trained on the correct use of ladders.    Abatement certification must be submitted for this item.
