29 CFR 1926.451(c)(2)(v): Fork-lifts were used to support scaffold platforms while the entire platform was not attached to the fork and the fork-lift was moved horizontally while the platform was occupied.  On or about 07/17/2013, an emplopee was observed riding on top of a load of material being lifted by a rough terrain fork lift to the top level of the scaffolding, approx 30 ft high, along the north side of Building 2. This exposed the employee to a fall onto construction material and debris.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.  On or about 07/17/2013, the employer did not ensure that an employee positioned on a elevated wood platform attached to the forks of an orange extendable boom rough terrain fork lift was protected from falling. The scaffold platform was not equipped with a guardrail system and the employee was not equipped with a personal fall arrest system to protect against fall hazards up to 30 ft above ground level.
