29 CFR 1926.501(b)(1): "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On or about July 17, 2013 and times prior thereto, employees of Southwest Drywall Systems, Inc. performed framing on an expansion being constructed for the E-Z Mart located at or near 11911 Mara Lynn Road in Little Rock, Arkansas. Employees were observed working on the outside of the framing, exposing employees to a fall distance to approximately 9 feet 6 inches to the ground level below.

29 CFR 1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. On or about July 17, 2013 and times prior thereto, employees of Southwest Drywall Systems, Inc. performed framing operations for an extension to the E-Z Mart located at or near 11911 Mara Lynn Road in Little Rock, Arkansas. The employer had not provided training to employees exposed to fall hazards.
