29 CFR 1926.451(b)(1): Platform(s) on all working levels of scaffolds, were not fully planked or decked between the front uprights and guardrail supports such that the space between adjacent units, and the space between the platform and the uprights: On or about 7/11/13, in front of the building , the employer allowed employees to stand on the top level of a fifteen foot of a tubular welded frame scaffolding which was not fully planked. The employees were washing the front side of the building. The measured distance from the last board to the upright was a measured three feet.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, sturcure, personnel hoist, or similar surface was not used. Crossbraces were used as a means of access. On or abour 7/11/13, the employer allowed employees to use the crossbraces on the welded tubular frame scaffolding to ascend and descend from the working levels. The tubular frame scaffolding was located in the front of the building.

Such activities shall be performed only by experienced and trained employees selected for such work by the competent person: On or about 7/11/13, the employer allowed employees work on tubular welded frame scaffolding that was not erected by a competent person qualified in scaffold erection, moving, dismantling, or alteration. Employees were working at an height of fifteen feet.
