29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety:        a)  Main Entrance to House - On or about 07/10/2013, the site competent person did not remove two utility workers from a 8 ft. deep excavation, comprised of Class B soil and having vertical walls, that had no protection against an accidental cave-in.      Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that:     a)  Main Entrance to House - On or about 07/10/2013, utility workers working in an 8 foot wide by 10 foot long by 8 foot deep excavation, were not provided with protection to prevent accidental cave-ins. The excavation was provided with only one hydraulic shore that was extended 8.5 feet between two shoring sheets a configuration which is not in conformance with Table D-1.3.     Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1926.652(c)(2)(iii): Manufacturer's approval to deviate from the specifications, recommendations, and limitations were not in written form at the job site during construction of the protective systems:      a)  Main Entrance to House - On or about 07/10/2013, the contractor had no tabulated data available on the job site for hydraulic shoring that was being used in an excavation which was actively being excavated.     Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1926.652(e)(2)(i): Excavation of material to a level no greater than 2 feet (.61m) below the bottom of the members of a support system was permitted where the system was not designed to resist the forces calculated for the full depth of the trench:       a)  Main Entrance to House -  On or about 07/10/2013, workers were exposed to a cave-in hazard attributed to scaffold boards that were used in conjunction with a hydraulic shoring system whose bottom edges were located three feet above the bottom of the excavation.     Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
