29 CFR 1910.132(a): The employer failed to provide protective equipment wherever it was necessary by reason of hazards of processes or environment encountered in a manner capable of causing injury or impairment in the function of any part of the body. (a) Marsh Creek LLC, 3190 West 14th Ave., Denver, CO 80204; On and before July 18, 2013, the exposing employer failed to have each affected employee use the types of personal protective, in this case a personal fall arrest system, that would protect the affected employee from the fall hazards present by the work they were conducting. Employees were observed servicing a cell phone tower located on the roof of an apartment building. Condition exposed employee to fall hazards of approximately 70 feet from a 6 story building as he assisted in servicing a cell phone antenna.
