29 CFR 1910.178(l)(6):  The employer did not certify that each operator of a powered industrial vehicle had been trained and evaluated as required by this paragraph:     On or about July 18, 2013, and at times prior thereto, employee(s) were exposed to a potential injury from a vehicular accident while operating the Toyota Forklift Truck, Model 7FGCU25, Serial No. 61679, at the worksite, without proper certification to ensure training and awareness of surface conditions, maneuverability, and carrying capacity.

29 CFR 1910.1200(e)(1):  Employers did not develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met:   On or about July 18, 2013, and at times prior thereto, the employer did not provide the employees with a hazardous communication plan which included information on the adverse health effects associated with chemicals such as, but not limited to, Watco Danish Oil, which contains benzene, a listed carcinogen and irritant, and petroleum naphtha, an extremely flammable substance, while performing finishing work on wood doors.
