29 CFR 1926.95(a): Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact:     a) West Side of the Building - A mason was observed without personal protective equipment while working with wet mortar mix exposing him to potential eye and skin hazards, on or about 07/18/13.      Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.501(b)(15): Each employee on a walking/working surface 6 feet (1.8 meters) or more above lower levels was not protected from falling by a guardrail system, safety net system, or personal fall arrest system:    a) West Side of the Building - A mason was observed without fall protection pointing up existing bricks while standing on the ledge of the building exposing him to a 11 foot 4 inch fall hazard, on or about 07/18/13.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers:    a) West Side of the Building - A mason was observed without fall protection pointing up existing bricks while sitting on a tubular welded frame scaffold exposing him to a 13 foot 6 inch fall hazard, on or about 07/18/13.     The Mogoo Home Improvements was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(g)(4)(i), which was contained in OSHA inspection number 315456061, citation number 1, item number 3 and was affirmed as a final order on 07/05/2011, with respect to a workplace located at 815 K Street, NE, Washington DC 20002.
