At the job site, 1015 E. 1st, Tonganoxie, Kansas, the employer had not taken a defective ladder out of service. Employees were using the 20 foot Werner aluminum extension ladder to reach the upper areas of the steel fabricated containers. Employees were exposed to fall hazards of approximately 12 feet to the concrete surface.
