29 CFR 1910.1000(b)(2):  Employee(s) exposure to an airborne concentration of Hydrogen Sulfide listed in Table Z-2 in excess of the peak concentration of 50 PPM:   The employer did not ensure an employee was not exposed to hydrogen sulfide above the maximum peak above the acceptable ceiling concentration of 50 ppm.  On or about July 18th, 2013, an employee was exposed to hydrogen sulfide resullting in a blood thiosulfate level of 1.9 mcg/ml.

29 CFR 1910.1000(e):   Feasible administrative or engineering controls were not determined and implemented to achieve compliance with the limits prescribed in 29 CFR 1910.1000(a):   On or about July 18, 2013, the employer did not implement feasible engineering and administrative controls  to prevent employees from exposure to hydrogen sulfide (H2S).  Feasible engineering and administrative controls include, but were not limited to: a) installation of a sight glass to prevent the need for opening the thief hatch, b) performance of air monitoring and use of a personal hydrogen sulfide meter, c) installation of a fixed hydrogen sulfide monitor at the tank d) positioning of the employee upwind of any contaminants contained within the headspace e) use of a blower to direct hydrogen sulfide away from the breathing zone of the employee, f) ventilate and direct contaminants to a flare or to a location remote from the employee's breathing zone.

29 CFR 1910.134(d)(1): The employer did not select and provide an appropriate respirator based on the respiratory hazard(s) to which the worker was exposed.   On or about July 18, 2013, the employer did not provide in line air respirator to employees opening the hatch of a tank containing unknown quantities of chemicals exposing employees to inhalation hazards.
