29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: a) On or about 8/19/22 and 8/22/13, in a trench/excavation at 274 Brantwood Rd., Amherst,NY: An employee repairing a sanitary sewer line in a trench and his supervisor (ie. competent person for excavations) were not trained to recognize potential hazards of working in excavations and the applicable OSHA regulations to control or eliminate these hazards. ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.652(a)(1): 29 CFR 1926.652(a)(1) Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c): a) On or about 8/19/22 and 8/22/13, in a trench/excavation at 274 Brantwood Rd., Amherst,NY: An employee was repairing a sanitary sewer line in a trench that was approx. 8 1/2 ft. to 9 ft. deep x 3 ft. wide x 25 ft. long. The north and south banks of the trench were vertical, and the soil was "previously disturbed", so that by definition, the soil could not be "Type A". The employer stated that he followed the Timber Shoring Tables in 29 CFR Part 1926 for "Type A" soil. However, the shoring installed (four 4x4 crossbraces & two 4x8 sheets of 3/4 " plywood) did not meet the Timber Shoring Table requirements for Type A, B, or C soil. Additionally, the access ladder was installed outside of the shoring, and the employee was completely unprotected from the cave-in hazard when he entered the trench. NO ABATEMENT CERTIFICATION REQUIRED
