Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer does not furnish to each of his employees employment and a place of employment which are free from the recognized hazards of being struck-by loads suspended by underhung hoists that had not been inspected which are causing or likely to cause death or serious physical harm to employees:    This violation was observed on or about July 22, 2013, in the fabrication shop where employees were exposed to struck-by loads of steel being loaded, unloaded and relocated throughout the shop by the following underhung hoists that had not been inspected periodically and frequently by the employer    a) Shawbox, 3 ton hoist  b) Budgit, 1 ton hoist  c) Shawbox, 3 ton hoist   Pursuant to 29 C.F.R., 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including documentation to ensure that hoists are inspected frequently and periodically.

29 CFR 1910.253(b)(4)(iii): Oxygen cylinders in storage were not separated from fuel-gas cylinders or combustible materials (especially oil or grease), a minimum distance of 20 feet (6.1 m) or by a noncombustible barrier at least 5 feet (1.5 m) high having a fire-resistance rating of at least 1/2 hour.      The employer does not ensure that oxygen cylinders were separated from acetylene cylinders with at least a 5 foot barrier with a fire-resistance rating of at least 1/2 hour or a minimum distance of 20 feet.  This violation was observed on or about July 22, 2013, outside of the fabrication shop area, where employees were exposed to fire hazards where oxygen cylinders were stored with acetylene cylinders without a noncombustible barrier at least 5 feet high with a fire-resistance rating of at least 1/2 hour or a minimum distance of 20 feet.     Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that oxygen cylinders in storage are separated from fuel-gas cylinders by a minimum distance of 20 feet or by a noncombustible barrier at least 5 feet (1.5 m) high having a fire-resistance rating of at least 1/2 hour.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met.   The employer does not ensure that a written hazard communication program that describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met.  This violation occurred on or about July 22, 2013, and at times prior thereto, in the fabrication shop where employees were exposed to fire and chemical hazards when using compressed gases and chemicals such as, but not limited to, oxygen, acetylene, cutting fluids, and hydraulic oil without developing a hazard communication program.       Pursuant to 29 C.F.R. 1903.19 within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that a written hazard communication program is developed, implemented, and maintained that includes the criteria specified in 29 C.F.R. 1910.1200 (f), (g), and (h).
