On or about July 23, 2013, about 1:00pm. a). The fabricated frame scaffold was erected on the 5th story of the fire escape. A determination was not completed by a competent person on the stability to support the scaffold.

29 CFR 1926.451(f)(7): Scaffolds shall be erected, moved, dismantled, or altered only under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration. Such activities shall be performed only by experienced and trained employees selected for such work by the competent person. LOCATION: 51 7th Avenue South, New York, NY 10014, North West Corner of Building, 5th Floor. On July 23, 2013, about 1:00pm a). The fabricated frame scaffold was erected on the 5th floor fire escape of the building without a review of the stability of the fire escape.

LOCATION: 51 7th Ave South, New York, NY 10014 On or about July 23, 2013; a) Employees were not trained to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. Employees were working and erected a 14 foot high tubular welded scaffold system on the 5th floor fire escape of the building.
